ARCHIVED - Court ratifies curfew for non-cohabitants from 2 to 6am in Murcia region
The measure will remain in place until August 27
One of the principal reasons behind the current surge in new Covid cases is the amount of socialising between younger members of the population which has pushed the accumulated incidence rate in the Region of Murcia up to nine times the level it had reached before the last state of emergency concluded (see latest figures for Thursday July 29; cumulative incidence rate 444.5 per 100,000 of population).
In an effort to stem this upward movement, the regional government has prohibited the sale of alcohol after 10 p.m. from any outlet other than licensed bars and restaurants, is undertaking mass testings amongst the younger population and has now been given authorisation by the courts to prevent gatherings of non-cohabiting individuals between the hours of 02:00 and 06:00.
All of these measures aim to discourage gatherings of young people and limit the amount of botellón open-air drinking activity which is such a normal part of the summer months for young people here, although the virus can be spread just as easily during daytime gatherings, alcohol can be purchased before 10 p.m. and the virus is just as transmissable in any normal activity which involves close contact now that masks are no longer being worn in a public environment and given the numbers of holidaymakers attending concerts and mixing in a wide variety of spaces, the measures will have very little real effect other than to limit botellón drinking sessions.

The Administrative Litigation Chamber of the Higher Court of Justice of the Region of Murcia has had to ratify the prohibition of meetings of non-cohabitants between 02.00 and 06.00, as well as extending the limitation on the maximum number of people who can meet to 10 as both of these measures limit social movement, contrary to the Spanish Constitution.
In order for the regional government to enforce these measures, permission must be granted by the courts in the interest of public safety.
The measures, which will take effect from 00:00 on the day following their publication in the Official Gazette of the Region of Murcia (ie Saturday), will remain in effect until 11:59 p.m. on August 27, 2021.
